Pepsi Smash Flyaway “Pepsi Smash Flyaway” Official Contest Rules NO PURCHASE NECESSARY TO ENTER OR WIN.  A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING.  VOID WHERE PROHIBITED. 1.    HOW TO ENTER a.    Pepsi Smash Flyaway contest will begin on Wednesday, August 6th, 2008 at 12:00 am Eastern Time (“ET”) and end on Monday, August 11th, 2008 at approximately 12:00 pm ET. b.    To participate in the contest, you may enter via the following method(s):  Go to the contest page of the WNKS website at www.kiss951.com, click on the Pepsi Smash icon, and complete an official entry form including your first name and last name, complete address, city, state, zip code, home telephone number, date of birth, and valid email address, All entries must be received by Sunday, August 10th at 11:59 pm ET. c.    Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry.  The authorized account holder is the natural person who is assigned to the email address by an Internet access provider, online serve provider or other organization that is responsible by assigning email address or the domain associated with the submitted email address.  For purposes of these Official rules, “receipt” of an online entry occurs when the www.kiss951.com servers record the entry information upon clicking the submit button.  Any automated computer receipt (such as one confirming delivery of the e-mail) does not constitute proof of actual receipt by WNKS of an online entry for purposes of these official rules.  Use of any devise to automate entry is prohibited. d.    Only one Internet entry per person and one Internet entry per email address are permitted. e.    WNKS (the “Station”) is not responsible for entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties or other technological glitches. 2.    ELIGIBILITY RESTRICTIONS a.    The contest is open to all Station listeners who are 21 years of age or older and who legally reside in North Carolina or South Carolina.  Employees of WNKS, its licensee, its corporate parents, subsidiaries, and affiliates, its advertising agencies, participating sponsors/promotional partners, other radio stations in the Charlotte metropolitan area and the members of their immediate families and/or households are ineligible to participate or win.  Subject to all applicable federal, state and local laws and regulations. b.    Only one winner per household is permitted in any contest.  Listeners are eligible to win WNKS contest only once every sixty (60) days, and a prize valued over $600.00 or more only once every six (6) months.   c.    Winners must sign all required releases and present government issued photo identification in order to claim prize(s). d.    Contestants are required to provide truthful information and the Station will reject and delete any entry that it discovers to be false or fraudulent.  The Station will also disqualify any entry received from person under the minimum age requirement specified for this contest and delete any entry received from persons under the age of 13 in compliance with the Children’s Online Privacy Protection Act. 3.    PRIZES a.    One (1) prize will be awarded.  The prize is a trip for two (winner and guest) to Los Angeles, CA departing August 29, 2008 and returning August 31, 2008 including:  round trip coach class airfare for two; two (2) nights hotel accommodations (standard, double occupancy); a $200 Visa Gift Card; and two (2) tickets to the Pepsi Smash Concert on August 30th, 2008].  Approximate Retail Value:  $2,000 but actual value may vary depending on fares in effect at the time travel is booked. b.    Winner and guest must be able to travel on the dates specified or prize winner forfeits prize.  All other costs not specifically stated herein, including, but not limited to, taxes, meals, tips and ground transportation, are the responsibility of the winner.  Taxes are solely the responsibility of the winner.  Winner and travel companions must travel on the same itinerary and are responsible for obtaining all required travel documents including valid identification.   Winner and travel companions are responsible for obtaining travel insurance (and all other forms of insurance) where applicable, at their option, and hereby acknowledge that Station has not and will not obtain or provide travel insurance or any other form of insurance.  Winner may be required to present a valid credit card upon hotel check-in to cover any incidental expenses incurred during stay.  Certain travel restrictions may apply.  Travel arrangements must be made through prize provider.  No prize substitutions, cash equivalent, or transfer of prizes permitted except at the sole discretion of the prize provider.  Prize subject to availability and prize provider reserves the right, at their sole discretion, to award a prize of greater or equal value if the advertised prize is unavailable. c.    All prizes or prize certificates may be picked up at the office of the Station at the address below.  Winner will forfeit the prize if not claimed by August 18th, 2008 and an alternative winner will not be chosen. In the event that a prize or prize certificate is mailed to the winner, it will be with the prior written consent of the winner and therefore, winner assumes the risk of its loss.  The Station is not responsible for the safe arrival of a prize or prize certificate.   d.    There is no substitution, transfer, or cash equivalent for prizes, except that Sponsor may, at its sole discretion, substitute prizes of comparable value or cash.  The prizes are expressly limited to the item(s) listed above and do not include taxes, gratuities or any other expenses.  Other restrictions may apply. 4.    WINNER SELECTION AND NOTIFICATION a.    Decisions of WNKS management with respect to the contest are final. b.    One (1) winner will be selected on August 11th, 2008 at approximately 12:00 pm ET in a random drawing of all entries received. c.    Winners need not listen or be present to win. d.    Odds of winning depend on the number of entries received.   e.    Winner will be contacted by phone on August 11th, 2008 at 12:10 pm.  If Station is unable to contact winner within three (3) days of notification attempt then the winner forfeits prize and an alternate winner will be selected in a random drawing of all remaining eligible entries. f.    Winner and travel companion must execute and return any required affidavit of eligibility and/or liability/publicity release by August 18th, 2008 at 5:30 p.m. or the prize winner forfeits the prize and an alternate winner will not be selected. g.    If a potential winner cannot be contacted, fails to sign and return the required affidavit of eligibility and liability/publicity release within the required time period, or if a prize or prize notification is returned as undeliverable, potential winner forfeits prize. 5.    CONDITIONS a.    Payments of all federal, state and local taxes are solely the responsibility of the winners.  Winners may be required to sign an IRS Form W-9 or the equivalent. b.    By participating in the contest, the winner or winners agree to have their name, voice, or likeness used in any advertising or broadcasting material relating to this contest without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.   c.    Prior to awarding any prize or prize certificate, STATION in its sole discretion may require contest winners (and their travel companions, if any) to sign a liability release, agreeing to hold STATION, its corporate licensee, its parent, subsidiary and affiliated corporations, and the officers, shareholders, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the contest. d.    STATION, in its sole discretion, reserves the right to disqualify any person tampering with the entry process, the operation of the STATION Web Site or is otherwise in violation of the rules.  It further reserves the right to cancel, terminate or modify the contest if it is not capable of completion as planned, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort. e.    STATION reserves the right to make changes in the rules of the contest, including the substitution of a prize or equivalent value, which will become effective upon announcement. If due to circumstances beyond the control of STATION, any prize related event is delayed, rescheduled, postponed or cancelled, or if transportation is severely impeded; STATION reserves the right, but not the obligation, to cancel or modify the contest and shall not be required to award a substitute prize. f.    Failure to comply with the contest rules may result in a contestant’s disqualification solely at the discretion of STATION. g.    STATION is not responsible for typographical or other errors in the printing, the offering or the administration of the contest, or in the announcement of a prize. h.    Copies of the written contest rules and a list of winners (when complete) are available during regular business hours at the main studio of WNKS, 4015 Stuart Andrew Blvd., Charlotte, NC 28217. 6.    Internet Contest Privacy Policy: a.    By use of this website and by entering the Contest, you agree to WNKS Web Site Terms of Use Agreement and to the use of your personal information as described in the Privacy Policy located at: http://www.kiss951.com/article.asp?id=103314.
